How Long Does it Take to Settle Wrongful Death Claims?

A question on the minds of those who have lost a loved one due to someone’s negligence is how long does it usually take to settle a wrongful death suit? The reality of a serious suit like wrongful death is that is takes a long time, usually many years, even if liability seems obvious.This is a result of the many steps that need to be taken as part of the process.

Investigation

The process starts with the investigation. During this time your attorney will thoroughly investigate your claim and gather evidence to build the case that a wrongful death has occurred and damages are due.

Pre-Suit Negotiation

Ultimately, damages in a wrongful death lawsuit are often going to be paid out by the insurance company for the other party being held liable. Insurance companies will often not want to go to trial if they feel the case is stacked against them, and so they may offer a settlement. This may or may not be acceptable, and the pre-suit negotiation is a chance to determine if there is something on the table worth taking.

Filing a Lawsuit
