A question on the minds of those who have lost a loved one due to someone’s negligence is how long does it usually take to settle a wrongful death suit? The reality of a serious suit like wrongful death is that is takes a long time, usually many years, even if liability seems obvious. This is a result of the many steps that need to be taken as part of the process.
The process starts with the investigation. During this time your attorney will thoroughly investigate your claim and gather evidence to build the case that a wrongful death has occurred and damages are due.
Ultimately, damages in a wrongful death lawsuit are often going to be paid out by the insurance company for the other party being held liable. Insurance companies will often not want to go to trial if they feel the case is stacked against them, and so they may offer a settlement. This may or may not be acceptable, and the pre-suit negotiation is a chance to determine if there is something on the table worth taking.
If no acceptable offer is made and accepted by this stage, then a lawsuit is filed. Given the load of cases being handled by the courts, there can be a long period between when a lawsuit is filed and the actual day in court.
This step is the occasion during which both sides are able to ask questions to prepare for the trial according to proper procedure.
This can take time since both sides will be requesting and reviewing many types of documents pertaining to the lawsuit, and will also be reviewing witness statements.
This is another opportunity for the case to be settled with the trial imminent. Though the other side may not have extended a good offer in the pre-suit negotiation, they may now. A lot of cases are settled at this point without actually going to trial.
In the event that no settlement is reached, the case goes to trial and your attorney argues your case before a jury. The jury then decides the case through their verdict, and damages will subsequently be determined by the court.
As you can see, given all the steps in a wrongful death lawsuit, it can easily take years to arrive at a settlement.
